The problem is the woman and the sex, being a very tricky matter, defies any generalization. WPB having brought rape under criminal law has tilted the balance in favour of the female. Now any whore can blackmail any man of rape without any check. My question is: Can a man do the same? This is the very crux of the matter: The man and the woman are not equal at least sex-wise. Whereas the latter can only be raped, it cannot rape but blackmail the opposite sex with the accusation of the same. So how far is it justified to provide a weapon in the hands of the woman for unbridled blackmail as the WPB has already done?

Agreed. Seriously...enough with the Sharia. It just scares everyone, and life lived in fear is a life wasted.

karachi01, I have been reading your posts and you sound moronic. True Sharia can never be created in Pakistan because people like you and me have no correct knowledge of what true sharia is. Actually your so-called maulanas and dari-wallas are the worst. If a dari-wala can sit on a television program and say that a girl who was raped also is guilty of zina then where do you think this society will be with your so-called true sharia. Stop talking like an idiot and shouting sharia as your defence. I am pretty sure you are educated outside of madrassas so you can come up with a coherent idea as to what to do. People in Pakistan do NOT want ``true sharia`` as you call it. because since `47, mullahs, and gvernment has given them nothing in the name of religion. Yes ``true mullah sharia`` will force them to close their businesses during prayer times, or make them keep beard or burqa, but it will never provide them with food or basic things. These dari walas dont even know right from wrong. You really think their idea of sharia will provide anything of value to these poor people.

great article and I hope politicians get off thier lazy asses and make Pakistan civilized, at least in the issue of women`s rights.

I would make a small suggestion to you though to study the latest ammendments suggested to the hudood ordinance by the CII (council of Islamic ideology). In effect the ammendments say (http://www.cii.gov.pk/infoservice/meeting164.asp)

164th meeting of the Council was held in March, 2007. Some of the important issues on the agenda of the meeting were as under.

1. Zina bil Raza (Zina by mutual consent) and Zina bil Jabr (Rape)

The Council unanimously decided that Zina by mutual consent (Zina bil Raza) and rape (Zina bil Jabr) are two distinct and separate crimes. If a female complains of Zina bil Jabr, she will not be asked to bring four witnesses as in such a case she is a complainant and the state is duty bound to investigate the crime perpetrated against her. The culprit should be apprehended and if the offence is proved, the culprit should be punished.

2. Tazir if evidence is insufficient-deliberation

Council unanimously also decided that in case of Zina bil raza if four witnesses are not produced then the accused will be acquitted. In case of accusation of Zina the accused cannot be awarded any punishment under any other law. The Holy Quran counsels recourse to education, training and advice in such a case and punishment should be awarded only if at least four witnesses testify the commission of crime in the court of law, except in case of lian if the accused denies swearing to God or confesses crime or in particular circumstances if offence is established itself the decision shall be made according to the situation.

3. Deliberation on Haraba and Fasad Fil Arz

The Council declared unanimously that “Haraba” and “Fasal fil arz” (mischief on earth) should not be kept limited to the scope of decoity. If a murder is committed in the form of terrorism and Zina bil Jabr, then such an offence should also be declared as Haraba and the perpetrators, according to their conditions, should be awarded all the punishment prescribed in Sura Maida of the Holy Quran for the crimes of Haraba and Fasal fil arz.

4. Condition for Judge to be a Muslim

The Council unanimously declared that after proper codification of law, the condition for a Judge being a Muslim is uncalled for.
