My understanding is that, to be punished under criminal law would have required to prove culpability to a specific act and not to a general desire to wage a jihad against the West. This was not proved in the case of Momin Khwaja.

He could have perhaps been prosecuted for the possession of assault rifles, if they were unregistered. But that would have been a minor crime and to prove even that would have required that the guns were owned by Momin and not by any other member of the Khwaja family.

Would you be happy if I had used quotation marks while stating "respectable family". They do meet the generally accepted notions of respectability, i.e., formal education, professional careers and respected in their own community.

I do not have any extensive knowledge of how Islam is practised in most families but I won't be surprised if these stories are told to Muslim children in the same way as the stories of Ramayana and Mahabharata are told to Hindu children.

The anti-terror legislation was enacted in the aftermath of the 9/11 attack and, in that sense, you would be right to say that its focus is Islamic terrorism. But its scope is quite wide and is not restricted to Islamic or even religion-based terrorism. For example, Tamil Tigers is an ethnic based organization but it is classified as a terrorist organization in Canada and its members are under constant surveillance. So, if any of them is found enabling terrorism in Sri Lanka, he or she could also be prosecuted under this legislation.

The law has been challenged in the Supreme Court of Canada and some of its provisions have been affected, but most of the law has been upheld by the court.

"The case also proved the necessity for such legislation; Khwaja could not have been proved guilty of any criminal charge and he would have gone scot-free without the anti-terror legislation"

Is this really true?
One could provide material help to people conspiring to blow up places and not be charged with any crime?

Dost Mitre:

Tell me why do you say, "..Khwaja was born in Canada and came from a well-respected family. His father was an academic and mother also well-educated.." wheras you wrote, "....

".The most incriminating evidence against Khwaja was provided by himself, through his numerous emails written to his co-conspirators and his girl-friend. He wrote: “I always wanted to be a soldier, cuz when I was like five yrs old me mum and I would read story about Ali radiAlla Anhu and how he chopped off the head of Marhab the kafir [infidel] and about jihad and stuff,

What kind of mother is she when she pumped at such a young age this toxic poison of killing and chopping of head of Mathab and engaging in Jihad?

kamath

The whole things reeks of insane hatred for fellow human beings and killing innocents.

This law allows extra measures to police.
The the law discriminates as is specifically targeted against Muslims. The law may be passed by law ministry but probably it will be contested as illeagal targeting religious minority group and thrown out by Supreme court of Canada ?
Good day
