majumdar, no. There's a huge constitutional hitch there.

CJ simply cannot keep the oath-taking judges without a constitutional amendment, which is out of question. Judges in Pakistan can ONLY be fired by the Supreme Judicial Council, and CJ is compelled to convene that in case of these judges. Nothing Parliament can do about that.

Such an amendment will destroy the Judiciary forever after all this struggle and no one will go for it.

Zee sahib,

Once Ifti is again made the CJP he can simply "bench" the judges who took oath illegally without actually sacking them. Similar thing is sometimes done in Indian courts to basically sideline judges with questionable integrity as dismissal is very diff (See below).

I think it is time Pakistan took the Indian route on judges where once appointed they can ONLY be dismissed only by a Parliamentary Impeachment process ( 2/3 majority reqd) to avoid future embarassment of this kind. *-)

No catch but many of the sacked judges will not accept it. Perhaps even the CJ.

Thing is, the judges who refused to take PCO oath acted in accordance with the constitution and suffered very badly for it. The ones who did take oath are guilty of subverting constitution and liable under Article 6. How will both sit together on the same bench? The restored ones are constitutionally required to prosecute the oath-taking ones.

Post by majumdar,

Oh well ... US has made a deal with Zardari to restore all the sacked judges plus keep all the PCO judges as well, and musharraf remains President for one year - in return for guaranteeing his Government for 5 years. That's what this meeting is about. Don't think it will will work.

Zee sahib,

The Urial is found in mountainous parts of Pakistan, A'stan and India (J&K, Ladakh, West Himalayas). It is true that they are hunted which is unfortunate becuase they are endanegred animals.

Zee sahib,

Uryal or Urial is a mountain sheep - Ovis vignei. Oryx are a sub-family of antelopes belonging to the genus Oryx, Arabian oryx is Oryx leucoryx.
